Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and GAMEPLAY WIZ SERVIÇOS DE INTERNET LTDA ("GamePlay Wiz," "GPW," "we," "us"), governing your access to and use of the GamePlay Wiz platform, websites, and services (the "Service") at https://gameplaywiz.com.

By creating an account or using the Service, you agree to these Terms and our Privacy Policy (https://gameplaywiz.com/policy). If you do not agree, do not use the Service.

1. Eligibility & Accounts

• You must be at least 18 years old to use the Service. By using it, you represent and warrant that you are 18 or older. We may terminate accounts we believe belong to anyone under 18.
• You must provide accurate information and keep it current. You are responsible for all activity under your account and for keeping your credentials secure.
• Authentication is provided by Clerk. Your use of Google or Discord sign-in is also subject to those providers' terms.
• One person, one account, unless we expressly permit otherwise.

2. The Service: What GamePlay Wiz Is

GamePlay Wiz is a two-sided marketplace connecting:

• Players, who submit gameplays and spend credits to receive coaching feedback; and
• Wizzies, experienced players who record "react" video reviews and earn points and Wiz Coins based on rankings.

GamePlay Wiz is a platform and facilitator. Wizzies are independent users, not our employees, agents, or contractors. We do not guarantee the quality, accuracy, or results of any review, and we do not guarantee that using the Service will improve your gameplay or ranking. Interactions between Players and Wizzies are between those users; we provide the tools, moderation, and payment/reward infrastructure.

3. User Roles & Wizzy Status

• A user may hold one active role per game (Player or Wizzy). Role changes are subject to a validation process and a cooldown period as described in the Service.
• Becoming a Wizzy requires meeting eligibility criteria (e.g., rank verification) and passing our validation. We may approve, reject, suspend, or revoke Wizzy status at our discretion, including for quality or conduct reasons.
• Wizzies agree to complete claimed reviews within the applicable time window and to meet our quality standards. Failing to do so may result in point penalties, warnings, or suspension as described in the Service.

4. Credits (Players)

• 1 credit = 1 gameplay submitted = 1 review. Credits are a limited license to use a Service feature; they are not money, have no cash value, and are non-transferable and non-exchangeable for cash.
• Credits come in several types (free, subscription, bonus/promotional, and purchased "pack" credits) with different lifecycle rules (e.g., some expire, reset, or are wiped on subscription changes; pack credits do not expire). The current rules are described in the Service and may change.
• Credits are consumed at submission. Except where we expressly provide a refund or compensation (for example, a recording failure or a gameplay left unclaimed beyond a set time), credits are non-refundable.
• We may grant, adjust, or revoke promotional/bonus credits, and we may modify credit rules, at our discretion.

5. Subscriptions, Packs & Payments

• Premium subscriptions and one-time credit "packs" are billed through Stripe. By subscribing, you authorize recurring charges until you cancel.
• Auto-renewal: subscriptions renew automatically at the then-current price for your region and plan until cancelled.
• Cancellation: you may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds or proration for partial periods, except where required by law.
• Plan changes, pricing, and regional currency (USD/EUR/BRL) are as presented at checkout. We may change prices prospectively; changes do not affect the current paid period.
• Failed payments may result in a "past due" state that suspends certain benefits (e.g., credit spending and pack purchases) until resolved.
• You are responsible for any taxes associated with your purchases except taxes on our net income.

6. Wiz Coins & Rewards (Wizzies)

• Wiz Coins are a virtual reward currency. They are not money, have no cash value, and cannot be transferred, sold, or exchanged for cash. They can only be redeemed for rewards we make available in the Wiz Store (currently gift cards).
• Coins are earned through ranking payouts based on points and are credited after each ranking period settles. Coins do not expire while your account is in good standing.
• Forfeiture: coins and pending payouts may be forfeited if your account is suspended, banned, or deleted, as described in the Service.
• Gift-card redemptions are fulfilled by a third-party provider and delivered by email. Gift cards are subject to the issuer's terms, and many are region-locked — you are responsible for selecting the correct regional variant for your account/region. We cannot verify your region and cannot refund coins for a redemption that has been fulfilled. We are not responsible for issuer restrictions, expirations, or losses once a code is delivered.
• We may modify the rewards program, coin values, pool sizes, catalogue, and thresholds at our discretion.

7. Your Content & License to Us

"User Content" means anything you submit or create on the Service, including gameplay recordings, react-video reviews, profile fields, notes, ratings, and comments.

• You retain ownership of your User Content.
• License to GPW: you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, transcode, translate, create derivative works from, publicly display and perform, and otherwise use your User Content to operate, provide, promote, and improve the Service — including displaying reviews and gameplays publicly on the Service (e.g., on Wizzy profiles, the Community Feed, and via shareable links).
• AI use: you further grant us the right to process your User Content with automated and AI systems and to use it to develop, train, fine-tune, evaluate, and improve GamePlay Wiz's models, features, and services.
• License survival: because reviews, gameplays, and related records are preserved after account deactivation (see the Privacy Policy), the licenses above continue with respect to User Content you submitted, to the extent needed to operate the Service, even after you stop using it.
• Your warranties: you represent that you own or have all necessary rights to your User Content, that it does not infringe any third party's rights, and that you have the right to grant these licenses. You are solely responsible for content you upload, including ensuring you have the rights to any gameplay footage you submit.

8. Acceptable Use

You agree not to:

• Upload content you do not own or have the right to submit, or that infringes intellectual property, privacy, or other rights;
• Submit unlawful, harassing, hateful, abusive, defamatory, sexually explicit, or otherwise objectionable content;
• Cheat, boost, use unauthorized software, or misrepresent gameplay or rank;
• Manipulate ratings, rankings, points, credits, coins, or promotions; collude; or create fake or multiple accounts to gain an advantage;
• Circumvent, disable, or interfere with ads, security features, rate limits, or access controls;
• Reverse engineer, scrape, or access the Service by automated means except as expressly permitted;
• Provide low-effort, fake, off-topic, or bad-faith reviews (Wizzies);
• Abuse the report or moderation systems, or the refund/compensation systems;
• Use the Service in violation of any applicable law or third-party terms (including Riot Games, Discord, Twitch, Steam, and gift-card issuers).

We may remove content, and suspend or terminate accounts, for violations.

9. Reviews, Ratings & Moderation

• Reviews are validated by automated/AI systems before publication and may be held for human moderation. Players may report reviews that violate quality standards.
• We may, at our discretion, remove reviews, withhold or refund credits, apply point penalties to Wizzies, and suspend accounts based on moderation outcomes.
• Ratings and reports must be made in good faith. Abuse of these systems is prohibited.

10. Third-Party Services

The Service integrates with third parties, including Clerk, Stripe, Amazon Web Services, Google (AdSense), AI/LLM providers, Sentry, Riot Games, Discord, Twitch, and Steam. Your use of those integrations may be subject to their terms and privacy policies. We are not responsible for third-party services. GamePlay Wiz is not endorsed by, sponsored by, or affiliated with Riot Games or any game publisher.

11. Advertising

Free-tier users may see ads (served via Google AdSense). Premium subscribers receive an ad-free experience as described in the Service. Interfering with or circumventing ad delivery is prohibited (Section 8).

12. Intellectual Property

The Service, including its software, design, logos, trademarks, and content (excluding User Content), is owned by GamePlay Wiz or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

13. Suspension & Termination

• You may stop using the Service and deactivate your account at any time via My Account.
• We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or for conduct we reasonably believe is harmful to the Service or other users.
• Effect of termination: your access ends and your profiles are deactivated. As described in the Privacy Policy, your submitted gameplays, reviews, ratings, and related records may be preserved. Unredeemed coins and pending payouts may be forfeited. Sections that by their nature should survive (including Sections 6, 7, 8, 12, 14, 15, 16, and 17) survive termination.
• Active Stripe subscriptions may be cancelled upon account deactivation; no refund is provided for the remaining period except as required by law.

14. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT REVIEWS WILL BE ACCURATE OR USEFUL, OR THAT USING THE SERVICE WILL IMPROVE YOUR GAMEPLAY OR RANKING. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMEPLAY WIZ AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR VIRTUAL ITEMS (INCLUDING CREDITS AND WIZ COINS), ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.00. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Governing Law & Dispute Resolution

• Governing law: these Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-laws principles.
• Venue: except where mandatory law provides otherwise, disputes arising from these Terms or the Service will be resolved by the competent courts of Brazil. Under Brazil's Consumer Protection Code (Código de Defesa do Consumidor), a consumer may bring claims in the courts of their own domicile.
• Nothing prevents either party from seeking urgent injunctive or precautionary relief to protect intellectual-property or unauthorized-use claims.

17. General

• Changes to these Terms: we may update these Terms; we will post the updated version with a new date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.
• Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability: if any provision is unenforceable, the rest remains in effect.
• No waiver: our failure to enforce a provision is not a waiver.
• Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure: we are not liable for delays or failures due to events beyond our reasonable control.
